What happened?

The Board recently discovered an error in the computer program that calculates the amount of interest on the last month’s rent deposit that the landlord owes the tenant.

This problem was addressed as of April 10, 2008.


What does this mean?

This means that for some orders issued between January 2, 2008 and April 9, 2008, the computer calculated that the landlord owed the tenant an amount of interest that was too high. 


What is the amount of the error?

In general, the error in the amounts calculated ranges from $3 to $20.  The amount of the error depends on:

  • The amount of the last month’s rent deposit, and
  • How long it has been since the landlord last paid the tenant interest on the last month’s rent deposit.  To see some examples, click here.

Which orders are affected?

The error only affects some of the L1, L2, L4 and T1 orders issued between January 2, 2008 and April 9, 2008. 

Your order is not affected if:

  • The landlord had not collected a last month’s rent deposit
  • Interest had been paid on the last month’s rent deposit for the period that ends on December 31, 2007
  • In the order, interest was determined to be owing for a period of time beginning on January 1, 2008
  • In their eviction application, the landlord did not claim compensation for occupation of the unit after the termination date
  • It is an L1, L2 or L4 order and it did not terminate the tenancy and evict the tenant
  • It is an L1 order and the tenant paid the necessary amount to void the order
  • It is a T1 order, but it does not include a requirement that the landlord pay the tenant interest on the last month’s rent.

Can I get my order fixed?

If your order is affected by the error you can ask the Board to fix it.  To do this, you must file a Request to Amend an Order.  You can make this request for free.  You do not need to ask for an extension of time in this case, even if it has been more than 30 days since the Board issued your order.

Note:  under the law, the Board may decide not to amend your order if the amount of the error is $5 or less.
