Revisions to the Board's Notice of Termination forms

Earlier this month it was brought to our attention that some of the Board approved termination notices may not meet the requirements of clause 43(2)(a) of the Residential Tenancies Act.

Clause 43(2)(a) of the RTA  requires that any notice of termination given by a landlord must inform the tenant that if the tenant moves out in accordance with the notice, the tenancy terminates on the Termination Date set out in the notice.  While this information was included in the Board’s new N4 form, it was not included on the other landlord notices of termination. 

The “Important Information” section of each of the notices listed below has now been revised to address this issue: 

  • N5 – Notice to Terminate a Tenancy Early
  • N6 – Notice to Terminate a Tenancy Early – Illegal Act or Misrepresentation of Income
  • N7 – 10-Day Notice to Terminate a Tenancy Early
  • N8 – Notice to Terminate a Tenancy at the End of Term
  • N12 – Notice to Terminate at the End of Term for Landlord’s or Purchaser’s Own Use
  • N13 – Notice of Termination at the End of Term for Conversion, Demolition or Repairs.

Effective May 22, 2007, the revised versions of these notice forms should be used.  The revised notice forms are available at all our offices, and from the Notices of Termination page of our website. 

We are also working on updating our Merge Program to include the revised forms.  We anticipate that it will be ready in late June / early July.  In the meantime, the current version of the program on our website will continue to function for all other forms and notices, including the N4 and L1.

You are encouraged to begin using the revised notice forms right away.  If you continue to use the old versions, there is a possibility that the notice could be found to be invalid because it does not meet the legislative requirements.
